Conditions of Use

We shall offer you our services, subject to the terms listed in this document below. You agree to the following terms each time you use this website, visit it, or make a purchase. For this reason, we strongly advise you to thoroughly read them.

Privacy Policy 

We encourage you to review our privacy policy on the collecting of user data before continuing to use our website. It will enable you to comprehend our procedures more fully. 

Copyright 

All digital files, photos, text, graphics, and logos that are published on this website belong to "Learn Portuguese" and/or its content authors and are safeguarded by international copyright regulations. The whole content compilation on this website is the sole property of "Learn Portuguese", which also holds the copyright authorship for the compilation.

Communication 

All correspondence with us is conducted electronically. 

You will be interacting with us each time you visit our website, send us an email, or send us a digital message. By signing this, you agree to receive information from us. We will send you emails on a regular basis if your sign up for our website’s news subscription. 

We will keep in touch with you by sending you emails and publishing announcements and newsletters on our website. Additionally, you acknowledge that all notices, agreements, and other correspondence we send to you electronically comply with the legal requirement that they be in writing. 

Relevant Law 

By using this website, you acknowledge that these terms of service and any disputes that may arise between "Learn Portuguese" and you, its business partners, or associates shall be governed by the laws of England and Wales, without reference to the conflict law principles. 

Terms of Payment 

All program content is only accessible to active members who have been authenticated by a recurring payment, the frequency of which was decided upon when the membership was first started. Your membership fee will be automatically processed at the predetermined frequency. 

Prices 

We maintain the right to alter a membership’s cost. If any pricing changes are coming up, we will notify you a full month in advance. We will also make it clear when the changes will take effect and how much your membership will cost when they do. You will have the normal right to cancel your membership during this time, in line with the terms, conditions and regulations of the membership. The cost of your membership will be adjusted in line with the notice if you do not cancel it by the deadline specified in the notice. 

Trial Periods 

A member will have complete access to the program during the trial time. Until the end of that time, there will be no fees. After that, payments will start based on the membership type that was decided upon at the start of the trial period. The user will remain able to access the program until the day and hour the first payment was due if they want to discontinue their subscription within the trial period. As stated in our "termination of membership" policy below, we have the right to end trials at any time. 

Cancellations 

There are no extra costs if a member decides to cancel their subscrption at any time. To accomplish this, use the contact page on our website to get in touch with us.

Until the subsequent renewal date following cancellation, he or she will remain able to access the program and its contents. 

Refunds 

Refunds are not available for any fees or payments. 

Membership Termination 

Your membership will be immediately placed on hold and you will not be able to access the program until the regular payments are made in line with the terms and membership level. Membership is a reward for community members who abide by our fair rules and show consideration for other community members; it is not an automatic privilege. 

We hope that you will remain with us for a while. However, we reserve the right to determine whether or not your usage of Learn Portuguese conforms with these terms using reasonable discretion. Your account may be suspended or terminated by us at any time for any of the reasons listed below, among others. 

1. if you violate our guidelines
2. if your actions are inconsistent with the principles we uphold
3. if your actions have the potential to hurt us or our members 

You will no longer be accepted in our community if we decide to permanently terminate your Learn Portuguese membership, thus you must not apply for a new account. 

Changes in membership 

Learn Portuguese has the right to unilaterally alter the terms and conditions of membership at any time without providing each member with additional notice. Unless otherwise specified, these modifications will be effective immediately. Any modifications to the terms and conditions will be posted on Learn Portuguese’s website. Members must however, keep themselves informed about any modifications to the terms and conditions. 

Disputes 

Any disagreement arising from your use of our website or from goods you buy from us will be settled in accordance with English law, and you agree that these courts have exclusive jurisdiction. 

Emails, Reviews, and Comments 

Visitors are allowed to post and share content as long as it is not offensive, defamatory, unlawful, threatening, violates intellectual property rights, invades privacy or harms third parties in any other manner, software viruses, political campaigns, and commercial solicitations must not be present in the content. 

We retain the right, but not the responsibility, to modify and/or remove any content. You give "Learn Portuguese" the non- exclusive, royalty-free and irrevocable right to use, reproduce, publish, and alter your work in any media worldwide at the time of posting. 

Site Access and License 

As long as you continue to make the regular payments that were agreed upon when you signed up, we give you limited permission to use this website for personal services. Only the person whose information was originally submitted can use the account created upon signing up. 

Under no circumstances may an account be transferred or used by someone else. 

Downloading, sharing, or altering any of its material is prohibited. Only with our written consent may this be done. 

Users 

Users have to be older than eighteen. You alone are in charge of protecting the privacy of your personal information (password and username) if you have an account on this website.
 

Any activity that takes place using your password or account is your responsibility. We retain the right, at our sole discretion, to cancel orders, modify or remove content, and terminate accounts. 

Liability Disclaimer 

To the fullest extent permitted by applicable law, we explicitly disclaim all implied warranties, conditions, and/or representations, including but not limited to implied warranties of merchantability fitness for a particular purpose, or non-infringement. We also make no express warranties or representations regarding the quality and/ or accuracy of the Content, the Websites, or the Services. 

We provide the Websites, Content, and Services "as is" and disclaim all liability for any use or reliance on the Websites, Content, or Services as well as for any delays or interruptions in the Services.

Furthermore, we can not guarantee that the Websites, Content, or Services are accurate, comprehensive, complete, quality, current, error-free, compatible, secure, or suitable for their intended use. 

Learn Portuguese makes no guarantees regarding the suitability of the services or websites, their compatibility with your computer hardware, mobile devices, or environment, or the absence of viruses or other harmful elements in the website, services, servers, or emails that Learn Portuguese may send. 

We limit our liability to the maximum extent allowed by applicable law. Specifically, we will not be held accountable for any harm we inadvertently cause, nor will we be held accountable to you for any actual, incidental, indirect, or consequential loss or damage, regardless of how it occurred. However, nothing in this Agreement will be construed to restrict or exclude any liability that may be restricted by law. 

For instance, we will not be held accountable to you for any of the following damages, whether they result from a contract, tort (including strict liability and negligence), or other circumstances (including whether the loss or damage was anticipated, recognized, or anticipated): 

(i) a reduction in revenue; 

(ii) a reduction in real or projected earnings; 

(iii) a reduction in the use of funds; 

(iv) a reduction in expected savings; or (v) a loss, corruption, or damage to data, systems, or programs. 

The aforementioned limits may not apply to you in full or in part because some states or jurisdictions do not provide exclusions as extensive as those mentioned above or limitations of liability for incidental or consequential damages. 

Your only and only option is to stop using the Websites and the Services if you are unhappy with any part of them or with any of
 these conditions. 

You can be held accountable to both us and other people if your account is used in a way that violates the terms and conditions of this agreement, even though we will not be responsible for any losses you sustain from any illegal use of your account. 

Learn Portuguese, its affiliates, officers, directors, employees, and agents consent to defend, indemnify, and hold harmless Learn Portuguese from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney’s fees) resulting from: 

(i) your use and access to the Websites and Services;

(ii) your violation of any term of this Agreement;

(iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or

(iv) any alleging that your User Provided Content caused harm to a third party. 

Both this Agreement and your use of the Websites and Services will be governed by this defense and indemnity requirement. 

Learn Portuguese may occasionally give users of the websites the chance to buy services from outside vendors. It is your obligation to make sure you have read and comprehended the terms and conditions that apply to those third parties’ websites, which differ from those that apply to the websites. 

You acknowledge that Learn Portuguese does not guarantee, is not liable for, and does not recommend any goods or services supplied by third parties. You also agree that any complaints or issues with those goods or services will be directed to the third party provider, not Learn Portuguese.
